General Terms and Conditions (GTC)

  1. Scope
    1.1 These General Terms and Conditions (GTC) apply to all orders placed through our online shop teefvitaeplus.de by consumers and businesses.
    1.2 A consumer within the meaning of Section 13 of the German Civil Code (BGB) is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or independent professional activity.
    1.3 A business within the meaning of Section 14 BGB is a natural or legal person or a partnership with legal capacity who, when concluding the contract, acts in the course of their trade, business or independent professional activity.
    1.4 Conflicting or supplementary terms of business customers become part of the contract only if we have expressly agreed to their application.

  2. Contracting party, conclusion of the contract, correction options

    2.2 The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding online catalogue.
    2.3 By clicking the ā€œPlace order with obligation to payā€ button, you submit a binding order for the goods in your shopping cart.
    2.4 We confirm receipt of your order immediately by email (order confirmation). This order confirmation does not yet constitute acceptance. The contract is concluded when we accept your order by a declaration of acceptance (separate order acceptance) or by dispatching the goods.
    2.5 You can correct input errors before submitting the binding order using the correction options provided during the ordering process.

  3. Contract language, storage of the contract text
    3.1 The contract language is German.
    3.2 We store the contract text and send you the order details and these GTC by email. If a customer account exists, you can view the order details there.

  4. Prices and shipping costs
    4.1 All prices are final prices in euros including statutory VAT, plus shipping costs.
    4.2 The shipping costs are displayed during checkout before you submit the binding order.

  5. Delivery, delivery time, shipping service provider, partial deliveries
    5.1 Delivery takes 1ā€“3 working days within Germany and 3ā€“7 working days within the EU, unless a different delivery time is specified for the item. For advance payment, the delivery period starts on the day after payment is received; in all other cases, on the day after the contract is concluded.
    5.2 Shipping service provider: Within Germany, shipping is by DHL; within the EU, by DHL International (unless otherwise specified at checkout).
    5.3 Orders received by 14:00 on working days are usually dispatched on the same working day; there is no entitlement to this.
    5.4 Partial deliveries are permitted insofar as they are reasonable for the customer. They do not incur additional shipping costs.
    5.5 Delivery delays due to force majeure, strikes or unavailability at upstream suppliers for which we are not responsible extend the delivery period appropriately. We will inform you of this without undue delay.

  6. Payment methods
    Depending on the checkout selection, the following payment methods are available in our shop:

  • PayPal
  • Credit card / other payment methods via Stripe
  • Klarna (e.g. invoice, instalment purchase, Sofort ā€” subject to availability)
  • Advance payment by bank transfer (only by individual arrangement, e.g. for orders placed by telephone or email)

  1. Retention of title
    The goods remain our property until full payment has been made.

  2. Right of withdrawal (consumers only)
    8.1 Consumers have a statutory right of withdrawal. You will find the details (conditions, deadlines, model withdrawal form) on our website under ā€œRight of withdrawalā€ and in your order confirmation by email.
    8.2 There is no right of withdrawal for sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery (Section 312g (2) No. 3 BGB).

  3. Warranty / liability for defects
    9.1 Statutory rights in respect of defects apply.
    9.2 For businesses: the warranty period is one year from the transfer of risk; Section 377 of the German Commercial Code (HGB) (duty to inspect and give notice of defects) remains unaffected.

  4. Transport damage
    If goods are delivered with obvious transport damage, please report such defects to the delivery agent as soon as possible and contact us without undue delay. Failure to report a defect or contact us has no effect on your statutory claims, but helps us to enforce our own claims against the carrier/transport insurer.

  5. Liability
    11.1 We are liable without limitation in cases of intent and gross negligence, and for injury to life, body or health.
    11.2 In cases of slight negligence, we are liable only for breach of material contractual obligations (cardinal obligations), limited to the foreseeable damage typical of the contract.
    11.3 Liability under the German Product Liability Act remains unaffected.
    11.4 Note on product characteristics/use: Our products are not medicinal products. They do not replace a veterinary diagnosis or treatment. The pet owner uses them at their own responsibility. In the case of pre-existing conditions or simultaneous administration of medication, we recommend consulting a veterinarian.

  6. Disclaimer for external links
    Despite careful review of content, we accept no liability for the content of external links. The operators of linked sites are solely responsible for their content.

  7. Data protection

  8. Dispute resolution / consumer dispute resolution (VSBG)
    14.1 We are not obliged and are generally unwilling to participate in dispute resolution proceedings before a consumer arbitration board.

  9. Place of jurisdiction and applicable law
    15.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
    15.2 In dealings with merchants, the exclusive place of jurisdiction is our registered office in Bƶblingen.

  10. Final provisions
    Should individual provisions of this contract be or become invalid, the validity of the remainder of the contract remains unaffected.
